Accounts

When you create an account with us by signing in with Google or Intuit, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. You are responsible for maintaining the confidentiality of your account and password, including but not to the restriction of access to your computer and/or account.

License to Use

Subject to your compliance with these Terms, Acuitist grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes. You agree not to reproduce, distribute, modify, or create derivative works of the Service.

Data Access and Service Provision

Our Service requires permission to access your data from Google Drive or QuickBooks Online. You grant us this permission for the sole purpose of providing our services. We are committed to the highest standards of data security.

All financial analysis is performed using a private, isolated Google Cloud Vertex AI model secured within a Virtual Private Cloud (VPC). This means your data is processed in a secure environment, isolated from the public internet, and is contractually and technically prevented from being used to train any public AI models.

Our use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

The output from our Service, including financial recommendations and lists of capital providers, is for informational purposes only. It is not a substitute for professional financial, legal, or tax advice. You should consult with a qualified professional before making any financial decisions.

Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Acuitist and its licensors.

Trademark Attributions

Google, Google Drive, and the Google logo are trademarks of Google LLC. This application is not endorsed by or affiliated with Google LLC.

Intuit and QuickBooks are trademarks and service marks of Intuit Inc., registered in the United States and other countries. Acuitist is not affiliated with or endorsed by Intuit Inc.

Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not to a breach of the Terms.

Limitation of Liability

In no event shall Acuitist, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Acuitist is based, without regard to its conflict of law provisions.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
